our family friend has no one in his family and he did not get married so he has no children no wife and he had no attachment towards his brother and in all his fix deposit and in insurance paper he made me the nominee and in relationship block he has written as son, so did i can get the better title and legal right as against his brother.if he file case in the court.

you are recorded as nominee as Mr XYZ son of Mr ABC (the depositor). You are not his son.
SO the moment you claim the deposits as Mr XYZ you claim so as son of Mr ABC (which you are not). You commit a crime of cheating u/s 420 (non-bailable)
When you have received money as nominee you do not acquire any title on the same you get this money as trustee of the legal heirs. If you fail to transmit to his legal heirs *including his brother) you commit a crime of BOT u/s 406/409 (non-bailable)
SO you are getting no title at all leave alone a better title than his brother.

It is believed the owner is Hindu.
Confirm!
The mother is ClassI legal heir and if she is alive on date of death of owner, she shall be the sole legal heir.
The bank can discharge its responsibility by making payment to nominee.
Whereas, you have NO document to establish the relationship of son with owner of FDR’s, Insurance policy etc.
WILL is the workable option for the owner that is alive and by his free will the owner can decide to dispose his estate by a valid WILL, in anyone’s favor.
In presidential towns; Mumbai, Chennai. Kolkota it is mandatory to probate the WILL.
A valid WILL can be contested.
If contested it will land in probate court of pecuniary jurisdiction.

The nature of your query gives hint about artificiality of the problem, as if an academic query only.
However, I partially agree with the opinion of Shri Sudhir Kumar, as the position is different with insurance claims.
However, if any realty is there in your story, the advice of Shri Yogen Kakade is quite workable.

Shocked and amazed with sickening comments of Dhingra.
You are not 1st one.
These post was not warranted but is again under compulsion and is wastage of my precious time and monies……………………………….since in this thread also Dhingra has attacked and abused.
That eventually is to be paid by this good for nothing Dhingra and his good for nothing M/s SUPER SPECIALTY SERVICES FOUNDATION (INDIA) that he advertises without any shame and claims as “Jackaal of all Trades”.
He has been cautioned that his cost and consequences of his misadventures are heritable.
We laugh daily on jockering of this Dhingra.
You may go thru his posts in all threads posted by LCI under his profile and note the abuse, nuisance that he has been littering at LCI for years and his worsened conduct since last 8-10 months.
He has proved that his situation is beyond scope of recovery.
He has mistaken himself to that extent that he feels that he will get some clientage by abusing at LCI……………………….and his abuses will get him some publicity and clients and some FEE for his daily bread, salt and tea.
Offer him a cut ( Dalaali) from your FDR/policy etc and you will see saliva (Laar) running out of mouth and he will virtually lie down on your feet.
You are liberty to oblige him.
You may show the printouts to our elders in the family, your own counsel at our location and proceed as most suitable to you.
