Non delivery of flat from the promoter.

My brother in law booked two flats in Bangalore. Full amount is paid to the promoter.the construction is over.
For the past 18 months the promoter is not responding for the delay in handing over the flats.
The promoter has not informed the reasons for the delay,
If he made any violation in the construction who is at fault.
please clarify.

You can file a case in District Consumer Forum(up to Rs.20 lakhs)or State Consumer Commission(above Rs. 20 lakhs to Rs.1 core)for deficiency of service by claiming each day compensation for delay. Alternately you can file a suit in Civil Court for specific performance of contract, but best option is consumer forum.

File a complaint to the consumer forum.

Issue notice to promoter and in this regard if he does not comly with notice than file complaint before consumer forum having jurisdiction and claim therein possession of flat also claim compensation towards mental and physical agonycaused to you.
