Sir i am working as a staff Nurse in a private hospital in punjab. I joined here as contract basis of one year. at the time of joining I submitted my all original Academic certificates in the company.in last June my contract period is over and now the company is not returning back my original certificates. they are asking me to deposit RS 25000 to get my certificates back.
Is the company has any right to hold back my certificates after contract period? What I can do for this? Can i move in legal ?

do you have any proof that original certificates have been deposited with the company .
in case company is refusing to return original documents issue legal notice to company . in said notice record the fact that company is trying to extort money by demanding rs 25,000 for return of certificates .
you can also file police complaint aginst the company

Check up your service contract and confirm as to whether the contract period is one year or more. Also check whether to pay Rs.25,000/- in case of termination of contract earlier. Are you still working in the same hospital? You may the help of an advocate who is handling labour law matters.

Follow the course of action suggested by Mr. Ajay Sethi. The Hospital seems to be trying to extort money from you to return ur certificates, which they are bound to on expiry or termination of ur contract.

Request them to return the documents. if they dont return. Send a notice. You will get it.

retaining the certificate after the completion of contract period amounts to illegality. You can very well issue notice on the lighter side or else give a complaint to the police regarding the same. On the other hand you are also having right to file a suit for damages as your opportunity to join elsewhere is spoiled by the erstwhile management.
