Not signing the attendance register in agm/sgm of the co-op. housing society meeting

Respected Sir,

In our Co-Op. Housing Society, situated in Dombivli of Thane Dist., some of the society members attending the AGM/SGM but not signing the attendance register and then saying they are not attended the meeting and we are not aware of the bill passed by the particular meeting.

In this regards, pls. suggest to the managing committee.

The person who has presided over the meeting may make note to this effect in the register and this aspect could be mentioned in the minutes of the meeting.

The proceedings may be videographed from future. Get the attendance marked at entry point in the beginning.

Get affidavit / letter from other members that they attended the meeting.

Sir,

According to the Bye-Laws of Maharashtra Co-Operative Housing Society, if the notice of the AGM/SGM is properly served and the signatures of the members duly recorded, the attendance of members has no effect over the legal resolutions passed at the said AGM/SGM.

These resolutions are equally binding on all the members whether they attend the AGM/SGM or not and the claim that they are not aware of the resolutions does not have any legal standing and they have to legally abide by the legal resolutions of the AGM/SGM.

I agree with the observations of Mr. Kishore Mehta.As suggested by Expert Mr. Venu the president may make a note in the attendance list that the members whose names he should record attended the meeting but refused to sign the attendance.This is only to witness the presence of the members concerned; but has nothing to do with the legal position stated by Mr. Kishore.
