Notice in drt?

Hi to all,

as we send notice in 138 nia for 15 days and then 30 days time of filing 138case,,, now rest of the loan amount is to be recovered by filing in DRT so do we have to send notice same as 138? kindly guide me here plz

No! DRT has it's own procedure independent of Negotiable Instrument Act.

It is not a matter of DRT and seems it is a matter of NI act. So contact a versed local lawyer.

You need to file Criminal complaint now and even a civil suit for recovery can also be filed and if amount is more than Rs. 10 lakh then have to go before DRT but no separate notice is required to be given in that case.
