There is a major problem in my city of traffic jam for whole day at railway crossing,Govt. is doing nothing to redress this problem,we have requested so many times to built a over bridge on the railway crossing,but all proved futile exercise,i want to send a legal notice to govt. in this regard and further intends to file a civil suit to solve this problem,kindly provide me some matter/citation/provisions etc. so that i can represent this problem in a better way.Thanx

Court will not interfere in the policy decisions of the Govt. Direction to construct a over bridge can not be given by the court.

halo sir,
u first approach ur local mp or mla and govt authourities, govt secretaries, cm, pm,( railway relates to central govt)then give ur representation either in person or thorugh post. ur representation may be on behalf or by an association or on behalf of several persons signed. later if no action u can approach high court, so that u can get ur way for remedy but not exact remedy. u can also file a civil suit under representative capacity. the filing of civil suit by u must be published in news paper. after that publication, all matters will take its own course. so very well u can file civil suit also. in that suit all persons to whom representation were given must be added as a party.

If the needs is a genuine one better to file PIL, after all there is bridge in the name of Justice Bhagwati.

File Public Interest Litigation but not Personal Interest Litigation else your 50,000/- will be not yours.
