Nullity of Marriage in India(Null and Void)
I filed Null and Void case on my wife on the following grounds of annulment
[Either spouse was already married to someone else at the time of the marriage in question]
Here are the details
Marriage Date : Aug 11th , 2013
Wife after 1 and half month of my marriage revealed the fact that she was married before .
My wife told that she eloped with her ex-husband, got married in a temple in the presense of friends.
My wife told me she didnt register her marriage.
My wife told me she and her father burnt her previous marriage photos.
Wife admitted that she was forced to marry me.
My wife left home after revealing her previous marriage in Oct,2013
As my wife cheated me i invited her and her family elders for a discussion.
Wife and her family elders denied the fact the she is already married[in the year 2006] and asked me proofs.
I inquired with her ex-husband family members and found that what my wife told me correct. Her ex-husband died on [Sept 12th, 2009] due to cancer.
My wife started denying her marriage and warned me about the women laws[498, 498(A) and domestic violence act]
My wife also told me no one including her ex-husband family will give witness in court.
I field a Null and Void case.
Wife contested the case on July 12 ,2014
The next court proceeding fell on Aug11,2014
So far my wife haven't filed any [498, 498(A) and domestic violence act]
Following are my questions. Please answer them inline
1) what kind of strong proofs i have to submitted to the judge and when i have to submit them. What proof will be a big evidence of her marriage
2) As she didn't stay in my house at all, is there any chance for [498, 498(A) and domestic violence act]
3) What kind of cases i can file against her and her family friends as they cheated me saying that my wife is very good in character.My wife
and her father's friend(cheated me like anything.
4) As my wife ex-husband is dead , will NULL and VOID grounds still hold good
5) Can i now go for Anticipatory bail to be on safer side, then how to get it and on what basis. Will i get enough time if i wait till they put FIR on me.
6) Will the judge give counseling to me. How should i talk with the judge. Can i directly tell him on face that
i don't want to live her as she and her family cheated me and not only that they mentally harassed and frighten me and family members.
Several time my wife tried to abuse [498, 498(A) and domestic violence act]
i was on loss of pay for 4 months and didn't go to job because of this mental harassment.
i was unable to concentrate on my job.
7) How to prevent my wife and her family to come to my house as the case is going on.
8) How much time will it take to solve this case (My wife keep on saying that she will not accept the divorce and ruin my life) and will see that i will not get married as my age is 35
9) I heard that i and my family members should not talk to them at all as the court case is running. In case she meets me , do i have to avoid her [my wife used to tell me that she will come my office]
