(Querist) 11 September 2016 This query is : Resolved
Respected sir
I have a land which we are cultivating from four generations in jamabandi from 1907-1908. And in jamabandi we are kastkar as gair marusi bila lagan bawaja kabja and in ownership column shamlat deh is shown from 1907-08 till 1955-56. And after that in ownership column civil panchayat is showna and we are shown as gair marusi bila lagan bawaja kabja derina. But after 2005-06 in jamabandi owner is civil panchayat and in kastkar column khudkast is shown but on in reality we are cultivating the land till now.
So I want to ask that can we claim for ownership of this land.

You should file a civil suit seeking ownership rights along-with seeking correction in the column of Jamabandi.

It seems your land is situated in Haryana. You must have filed this suit even after 30 years of possession. The Girdawri cannot be changed without court proceedings so if possession of Khudkasht of Gram Panchayat has been shown, that shall be got corrected and ownership rights shall definitely be provided to you.

SIMPLY:
1. File proper application, with all the available records and the agriculture tax receipts that you hold to the office of the local Collector's office, alongwith an undertaking to pay all nazrana (taxes, penalty, conversion, mutation charges etc.... )

2. The Collector will put up a hearing, by notice to all parties involved and pass order to mutate the related land in your name alone, with related conditions.

Keep Smiling .... Hemant Agarwal

You are a "tenant without payment of rent" "unauthorised occupier and cultivator of the land owned by gram panchayat (deh shamlat)".

Seek services of a local lawyer for declaration of title of the land on the basis of adverse possession.
