Dear sir,
I am staying in a pagdi system in commercial building for last 66 years in chennai,my grandfather paid some huge sum as pagdi at that time,we are paying taxes for that building for last 60 years in the name of landlord, as our business suffered loss we discussed to landlord to transfer our tenancy and leave the building for some pagdi but she refused for that and falsely issued a notice and filed a case against us to vacate the building immediately on the grounds of nonpayment of rents, we had paid rents regularly and also having receipts of rents paid to her ,is it possible for her to evict us on the grounds of non payments of rents, we have given advance of Rs 5lacs and now we issued notice to her that she is entitled to appropriate the same towards future rents until she withdraw this case ,as she is falsely trying to evict us.

if you have paid rents then you cant be evicted for non payment of rent .

If you have paid the rent and having receipts, if you have paid atleast one month rent as advance, she can not evict you.
In case she is not accepting any further rent, deposit the rent in the court, by filing a petition.

You might possess the rent receipts and if you have then nothing to worry and in that situation, follow the advice as given above.

I Thank you all for your replies,so if court ruling comes in our favour, what is the next step i have to take? Is it possible for me to file defamation suit against her for falsely try to evict me,is there any procedure for the same? Is it possible for me to transfer the tenancy rights to someone and get pagdi without her permission?as I am not interested in doing business anymore as I had suffered loss, but she is refusing to let me go on pagdi basis,because of her act I am forced to pay monthly rents.so I request panel of experts to give me a solution to this.Thanks in advance.

if courts deide in your favour then dont proceed in filing any case of defamation you would end up spending more money in legal fees .
for transfer of tenancy rights you need landlord consent
