Panchnama.

Querist : Anonymous (Querist) 16 March 2011 This query is : Resolved 
1) Panchnama vs Mahazars also when mahazars is made whether it is applicable in civil cases & tax matters cases.

2)Can any learned member elaborate the difference between substantive and corroborative piece of evidence. Please provide a case also telling the difference.
Also if possible with the case law (S) & example.

documents or witnesses that can verify the evidence or evidence on which reliance can be placed for the decision of the case is substantive evidence where Corroborating evidence is evidence that tends to support a proposition that is already supported by some evidence. For example, W, a witness, testifies that she saw X drive his automobile into a green car. Y, another witness, testifies that when he examined X's car later that day he noticed green paint on its fender. Or you can have corroborating evidence related to a certain source such as what makes an author think a certain way.

Panchayat nama is the work to seal the body of deseased person in front of five public person and there signature before postmartam with some suspected cause of death .

So as per the defination of substantive evidence we can say that Eg : A Person Sole Propertior in this books it shows that bank charges are Rs. 500/- than as substantive evidence we can say that the ledger copy of a Bank in which he holds the a/c also shows Rs. 500/- so the bank ledger a/c is verfiy by the sole propertior the same no comes so it is a substantive evidence. Becasue it has the evidence on which rlaince can be placed (i.e. bank ledger copy).

Also pls explain me in more detail of Corroborating evidence Pls .
