I am eldest son of my parents, we are 4 brothers (3 alive, 4 brother expired --has one son) & 2 Sisters. Our mother has left one property in her name in which my younger brother is living. We don't have any papers of that property. Now I along with 2 Sisters want partition suit. How can we proceed? Can we proceed without papers? & Can my sisters claim in that property?

Just collect the basic title documents or revenue records of the properties which you want to claim and file a partition suit.

Papers can be collectsd from the registering office & local bodies. 1st., U need to give a notice for partition & then proceed to court to file a Partition Suit.

Get certified copies of the documents from registrar office and file partition suit.

First of all in absence of any record in respect of Title of the property in question, it is futile to to talk about Partition.
U have to obtain Certified copy of the Title Deed from o/o the local Tehsildar before proceeding on the matter.
Thereafter consult an experienced Civil lawyer of your locality alongwith connected docs. for filing of the Partition suit.

How do you claim that your mother was the owner of "some" property?
Show the document to a local lawyer for proper analysing and guidance.
