This query is : Resolved
in the year 1979 non registration partnership firm NAMELY XYZ & CO, DO ACTIVITY OF LAND AND BUILDING CONSTRUCTION with partner A,B, and C,, in the year 1991 reconstituted partnership and D/E/F PARTNERS ADMITTED AND LATER PARTNER A/B/C ARE RETIRED, IN 2001 FIRMS REGISTERED IN REGISTRATION OF FIRM IN NAME OF XYZ & CO.. NOW THERE IS DISPUTE FOR PROPERTY MATTER, AND AS PER RESERCH FOUND THAT IN REGISTRATION OF FIRM FORM A, AS PER COLUMN (F) DATE ON WHICH EACH PARTNER JOINED THE FIRM, THERE IS NO NAME OF PARTNER A/B/C AND THERE ADMISSION DATE OF 1979 . SO MY QUESTION PARTENERS D/E/F MAKING FALSE /UNTRUE AND INCOMPLETE STATEMENT TO REGISTER THE FIRM . SO AS PER ABOVE MATTER ANY COURT CASE WILL BE APPROVED IN COURT, TO RECOVER THE LAND MATTER OF 1979

Instead of first going to the path of court, you need to make a representation to the Registrar of Firms and Societies containing the false statements of the applicants while getting the firm registered and demand de-registration and further criminal action on their part failing which file a civil as well as a criminal case against the erring persons as well as Registrar.

You have found in Form A that the name of partners A, B & C omitted. I opine the partners X, Y, AND Z might have been getting the registered firm as a fresh. It is fault of X, Y, & Z partners. so obtain the entire of copies of the registered Firm executed by X,Y, & Z and then ask the registrar how did he register the Firm by RTI. Then file case.

Certain problems can be settled only by an intervention of a court order.
Hence you may first exhaust the remedies available locally first and then approach court for relief and remedy.
You may discuss with a local advocate by producing all relevant documents and seek his opinion about the next step to be taken immediately
