Performace improvement plan

can company put an employee on non responding cases. Employee is responding but managers are trying to trap employee for non responding. Can it be a cause to put employee on PIP.
Company managers tried me to send at non performing territory by transferring to Ratangiri. But i performed good with 20% sales growth. Now reporting manager is trying to trap in non responding cases.
What law says for putting any employee on PIP to expel him out. Is there any case study or citation or judgement

Putting on PIP is a beginning of the plan to throw away an employee on the plea of inefficiency/ non-performance/ indiscipline.

But, it is not understood for what purpose you have asked for "Is there any case study or citation or judgement?" This creates a doubt as if it is not your personal problem, but is your academic query.

Can you please clarify, what you propose to do with the case study or citation or judgement?

However, if you really have a personal problem, you may send complete details to me through email [1962dcg@gmail.com ], as in one case the company was compelled to pay a hefty sum in the shape of severence allowance, rather than enforcing PIP on the employee.

Whether it is a government concern or private concern?

Try to improve relation with the head.

Keep all records of your performance and do not leave gaps to be questioned.

Discuss full situation with some senior.

Build proper and favorable written record e.g. being sent to non performing territory.


Download copies of each and relevant document.


If boss is trying to trap, build record.


In the end it is record that will rescue.


If you have some stake in Non Responding cases then others down the line and bosses also do have.


All depends how you act and build record.


I too agree that PIP is precursor to severance.


However you may show all docs on record to an able counsel ASAP.


What is this industry say; Insurance, banking etc and what is your designation and nature of duties?

It is my personal case. I am working as a Area Manager with a pharma company. I am serviing this organization since last 13 years.In this last 13 years company given me 3 geographical transfers and 4 divisional transfers. My last transfer was to Kolhapur at Sales then as a HR Manager. When i adopt to any geography or division. Management transfer me. I adopted to Kolhapur and to designation HR Manager then they transferred me to Ratangiri with a expectations that i wont be able to perform. But i performed because i know performance is the only criteria to sustain. Now i settled since last 11 months now i have doubt they may take step to put me on PIP. Now every my transfer management was different. Its companies undeclared policy to expel out employee withing 5 to 6 years. I pretend that i have strong back up so nobody directly take enmity with me.

You have already been suggested the steps you should take.


If you are included in PIP, then you can contest on merits.


If you have been a performer, throughout and have moved from sales to HR then you can look for a career in top companies.
