My wife is forcibly entered in my house when she was not divorced. She captured my all valuable items. I have given Legal Notice her but she has refused to give back my all valuable items which I have purchased. Then I have applied IPC406. My case was registered as private complaint under sec. CRPC 200. Court has taken the two times evidence also. Before charge court has taken the evidence then Respected Judge has framed charge then after charge evidence was also taken. That is also decided by First class Judge (lady). But in her final judgment she has given the relief to all accused & Every one got acquittal from this case. At present condition she got divorced by Family court and High Court also on the merit basis & she is forcibly captured my house & my all valuable items also. She deny to leave my purchased house and valuable item also. I want to appeal against her illegal judgment by First class Judge to session court. So i want to appeal on the session court, So I want to know following things:-
1. In which CRPC Sec. I can go for appeal to session court. Weather it is 372 (2) or 378 or any other section. Please clarify it is very urgent for me

Your wife forcible entered in house.
YOU SAY SHE WAS NOT DIVORCED THEN SHE HAD A RIGHT TO DO SO.
She took some valaubles.
YOU SAY SHE WAS NOT DIVORCED THEN SHE HAD A RIGHT TO DO SO.
You filed a criminal case and she was acquitted.
You cannot use the terms like "Illegal Judgement" on public forum you can criticise the judgement only in Appellate Court.
Met the nearest available lawyer with full papers if intending to file appeal.

Your wife, being not yet divorced, has got full right to your property, what to say of entry in the house.
Any court judgment cannot be treated illegal unless proved so by an upper court.
So, better hire serviced of some learned advocate on family law to fight your case effectively, if you feel there is any illegality in the judgment.

At present she is divorced from Family court from April-2010 & from HC August-2010 but she is captured my house and valuable items. But she is denied to give my valuable item & House.
