Respected sir,
Reference query 'land owners flat' on 10/7/18.Thanks all of you for your valuable suggestions sir.
we are five as landowner (three brothers and two sisters).Now as per agreement with promoter/builder cash amount(already received) and only one flat yet we have to receive.Flat's alottment/ possession letter should be mentioned with all five owner name or not? Pl. advice.

1. IF the property agreement is duly registered in Five names, THEN the same is legally conclusive for any & all futuristic purposes.
2. ANY one name from the registered Five names, can be mentioned in the "possession letter", and this one name can sign receipt of possession, on behalf all other four persons. The possession letter, being only a confirmation letter, has very little legal significance vis-a-vis when there is registered agreement.

If possession letter has little legal value why there is a need to issue a possession letter? In other words, does the expert wants to convey that possession of flat of some one legally entitled person can be given to any other non-entitled person through possession letter issued in other person's name? if that is so, quotation of relevant section of law becomes due.
But, question arises, what the developer wants to do has not been mentioned by you? Any reason for that? Also, do you believe that the developer would agree to issue a possession letter only in your name and also would handover possession of flats to you only for and on behalf of all of your brothers and sisters?
