Previous committee chairman non traceable

Dear sir,

This matter is from our society, the previous committee's chairman is not handing over the charge of society and the required NOC of previous committee to the bank to operate the account by the new committee. He was not traceable for couple of months and was not answering any phone calls or SMS sent to him. Now after couple of months he is contacting us over the phone only and not meeting in person and telling the committee member's that he will not sign on the bank's NOC and will not Hand over the charge to NEW committee, whereas his tenure as a CHAIRMAN is over on March 2011. Sir what can be done with this regards kindly guide us and let us know the procedure.

you dont need NOC from previous committee for operating bank account ?

what you need is copy of resolution by present managing committee appointing mr _____as chairman . ____-secretary , +++++++treasurer .

Pass a unanimous resolution against such person condemning his act and conduct, make a police complaint under section 406/409 IPC, report the matter in detail to registrar and enclose all such proceeding wherein it is required. Bank shall change the names of the account holders on the basis of such proceedings.
