Querist : Anonymous (Querist) 13 December 2011 This query is : Resolved
Dear Sir,

My mother purchased some property which I was quite young onmy name, she died some time back, now my father want to transfer it to my brother, which is in my name, how is this possible?
prabhakar singh (Expert) 13 December 2011
You are absolute and exclusive owner of the property and your father can not transfer it in your brother's name from his pen unless you visit sub registrar office to sign yourself in favor of your brother under mandate of your father. You need to guard against this much only.

Agree with Mr. Prabhakar Singh

Your father have no right to transfer your property.

You can as well issue Legal Notice, not to do so, and you object his act.
Devajyoti Barman (Expert) 13 December 2011
Need not worry much. Your property can not be transferred by any one except you.

I have similar opinion as Mr.Singh.
Raj Kumar Makkad (Expert) 13 December 2011
If you are agreed then there is no problem in doing so as there are various means to implement your desire but if you do not want to transfer then there is no force to get it done.

In my opinion, for the sake of good relations and family life, you should do what your father is saying as your mother had also provided you entire property out of her love and affection when you were in childhood.

whether you are minor or major at the time of transferring the property ?
if minor who is your guardian at the time of registration of the property ?
have you obtain the court permission in case you are minor ?
have you given General or special power of attorney to your father any time ?
