Property issue...please suggest

Hi Sir,

This is Sreenivas. I need your valuable suggestion on my father side property.

My Father's mother having some property of two houses. She has 3 sons (X, Y, Z) and my father is the last one (Z).
I am not sure about the old details, but when I enquired in municipal corporation office, the property was on the name of three brothers X,Y, Z till 2001.

Y died on 1994, and X died on 2001. Only my father (Z) is alive now.

we are staying far away from the combined property due to my my father(Z)'s job.

In 2001, when X died, his wife (Raja sree) transfered the entire property into her name by producing deth certificate of her husband (X) and legal heir certificate, on 6/5/2006.

Immediately after 6 months, Padmavathi transfered the entire property to her only daughter (Revathi) on 16/11/2006.

Till from that time, Revathi is enjoying the entire property of two houses.


My doubt is that, As the property is was on the name of three brothers (X,Y, Z), how can X's wife and X's daughter are dealing with the property officially with out the the knowledge of Y and Z (of course Y is died and he doesnt have kids) . Z i.e., my father can put case against this...?

Kindly let me know how can we proceed on this issue.

Forger to mention the thing that we dont have any documents related to that property, the only thing we know is the property was on the name of three brothers...The property actually belongs to (X,Y,Z)'s mother's mother (Grand mother). May be she made gift deed to three gand sons X, Y and Z.

First and foremost it is not clear how the property belonging to your grand mother (father's mother) appears in the municipal records in the name of X, Y and Z.

Only after knowing this, one will be able to say anything further.

In fact, you would be advised to approach a local lawyer, show your documents and to take things forward, instead of consulting here and there, where you will not be able to discuss things with complete details.

try to find the documents wherein property was purchased by your grand mother? whether in said agreement the names of X Y Z are mentioned as purchasers or that of your grand mother?
whether grand mother executed gift deed for transfer of property in name of X y Z ?

it is clear that it is your grand mother property and lastly you know that your uncle and your father name was included first you have to enquire with the sub registrar office with what document your aunt has transferred without the consent of your father and how they made it better first you acquire those papers and then consult a civil lawyer
