Hello

We are leaving in south mumbai .we have pagadi system and all the tenants paying rent regularly but 2-3 years landlord did not came to collect rent. we generally pays rent yearly.my question is
1) what is our duty ...? what does law says ?
what is the procedure ?
2) will landlord will fight in court against all the tenants that they are not paying rent .?

do you have any rental agreement ?
the landlord accepting your rental amount in a year

than what is problem now

how you can deposit that amount by cash or cheque

there is no such agreement exists.

ya he was accepting rent till 2010 by cheque but he is not coming to collect the rent..

When Landlord is not coming to collect rent
every tenant should send the rent by M.O. with a note that as he is not coming and collecting and has not accepted M.O. is being sent.If land lord refuses to receive M.O. and is returned by post office,a notice should be sent to the landlord that as he was being paid rent through cheque he use to collect,M.O. was sent which has been refused landlord should tell his Bank account number in which tenant may deposit rent,if he still fails to disclose his account and remain silent,an application should be moved in court to deposit the rent regularly in court.Doing so landlord can not brand tenant as defaulter and can not sue for eviction on this ground.
