This query is : Resolved
Hi all.
There is query regarding authentication of POA and sale.
Suppose a person had issued an registered POA to one member in 2007 and he again issued Notraised POA to another in 2015. A second person sale the flat by paying Indemnity bound too. Now when it came to society the society raised objection stating person once issued the POA cannot issue it further and not ready to give share certificate. Than what remedy available with me.
And is there any law that once POA issue to one can not issue to another without revoking the first one.
Plz help....
Thank you
V R SHROFF

1. A UN-registered POA (eg. Notarised POA) is lawfully "invalid" for all purposes relating to "immovable property".
2. POA for "immovable property". CANNOT be revoked without the express consent of the "interested" party (means POA holder).
Keep Smiling .... Hemant Agarwal

YOU ARE A LAW STUDENT, FINE,
BUT ASK DIRECT QUESTIONS. DO NOT SUPPOSE.. "Suppose a person had issued an registered"
IT MISLEAD US AS IMAGINARY & ACADEMIC QUERY. REAL PROBLEM BE ASKED DIRECTLY, LET IT BE OF ANOTHER PERSON, BUT SPECIFY THAT PL.
