Psu employee not working/obeying superior

I work as branch head with a bank. in my branch, my Asst. manager is quite aged and is alwys creating mess in branch with customers, not doing work, and rather sitting on work table with his legs on table. despite several requests for 10 months i beared but then i gve up on every effort to have cordial relations with him and work fr bank. so i reported it to management. but he is not even bothered abt that rather is threating me of baseless allegations.. what should i do in this case? he brings his SC/ST corp. status in between since he is office bearer in that.

1. Take care he may file false atrocity case on you. You have already reported the matter to your seniors. Let the senor management deal with such instances of insubordination. Quietly take some visual pictures of his such insubordination and verbal conversations if you have with him.

2. You just take care of the bank's work. Side line him and do not assign any more responsibility to him.

3. Be cheerful when you deal with such old employees who have become incorrigible.

4. save your self from further troubles. Ignore him but not the bank's work.

I recommend that u should create clinching evidence of his misconduct like photos of his sitting improperly at his work place, recording of his conversations with the customers and other staff members etc. Send a confidential report to the disciplinary authority with ur recommendation to suspend him and issue charge sheet. Ensure that u have some witnesses to depose in the inquiry proceedings. His scheduled caste status should not come in the way of taking disciplinary action. Otherwise ur inaction may send wrong signal to ur other staff that u are incapable of acting against an employee who is misbehaving in the office. If u feel this is not possible get him transferred from ur branch.

Agreed with Mr. Rohit Sharma, Mr. M V Gupta.

The majority of the banks do not have CCTV footage with audio.

You should record his baseless allegations, SC/ST status threats etc...............

If possible and workable use and audio/visual
device.

Assess:

--if other staff in the branch shall provide truthful statements or not?

--If HR, superiors shall take suitable and bold stand or not?

Once you have assessed the situation proceed further.

You are a manager hence you should thoroughly know 'Situational Management'.

Thank you so much gupta sir and sharma sir for such a good insight. I have clicked his pictures and also made a video of him talking in a very bad manner to me. However he has put counter allegations on me that i dont come to branch, though being a branch head i have to be out for business development and for 7 days i was so highly occupied that i along with my head cashier couldnt sign attndance register for 6 days.. but we worked in the branch. he photocopied all that and is alleging me with that.. PSU culture is like lots of paper work and file and there are chances of mistakes.. i am worried that even a slightest mistake could prove fatal for me.. so its really tensed atmosphere to work here..

Pl speak to ur superiors in confidence and keep them informed of all the facts. Ur absence at the Branch office on out door work should not worry u. Hope u keep a dairy of ur visits to ur customers and time spent on such occasions. if u are given car by the office, and u use the car for such visits ensure that the log book is posted properly with requisite details of the visit. U can use these records to explain ur absence at the office, whenever such need arises. Pursue the actions to be taken agaisnt the delinquent.

Obtain complaints from the customers. Lodge a complaint to your superiors along with the proof you have.

Immediately apprise your Personnel Dept of the bank, the gravity of the sitution. First secure a deputation for him from HO/ZO, to another branch, for few days. Then post him to a Regional/Zonal office, wherein he cannot face the customers. Such persons are a curse to the institution, but we have to live with them.
