Purchase of flat

I am planning to purchase a flat. The flat owner has given me copy of sale deed and BRS (Building Regularisation Scheme). I got link documents and EC from registration department. Recently I was informed that the survey no in which the apartment is situated is under ULC. Do I need to obtain NOC for ULC in spite of having BRS. The flat owner do not have NOC from ULC. Even NOC is not submitted BRS is done.

As a precautionary measure you may ask your vendor to get NOCs.

1. IF the Building is given an "occupancy certificate (OC)" by the local Municipal authority or the regional Town Planning dept., THEN no other documents are required to determine the legality of the building structure.
2. Alongwith the mentioned documents in your possession, check the OC and then you can conclude the purchase.

For the land, in which apartment was constructed, there is no mother document. Since BRS is given for the apartment by the local body no one in the apartment bothered about Occupancy certificate. Hence, there is no OC except flat wise BRS certificate.

to me, for ULC land, the NOC must be required.

You are investing lot of money in purchase of property, it is advisable to contact and consult a local prudent lawyer for better appreciation of facts/ documents, guidance and proceeding.
