Query about cruelty

Guest (Querist) 05 May 2013 This query is : Resolved
I have filed a divorce case under cruelty since December 2011 and my cross-examination is going on.Now suddenly out of the blue,my wife has emailed my cousin sister with a lengthy email making all sorts of false-accusations about me and denying any problems from her side(She hid previous uterine disorder from me).Can this also be considered Cruelty?
If so,how can I add it onto the affidavit as my cross-exam is going on?
Devajyoti Barman (Expert) 05 May 2013
Bring your cousin as witness and produce the copy of the e-maul.

Thank you sir,I have already submitted the affidavit...How can I add to it?Can I submit an addendum?

no need to further complicate the issue . confine your self to the peition filed by you and adffidavit filed as examination in chief . in your cross ypou will be questioned on allegations of cruelty made by you . be prepared with your answers

So you think it`s better not to submit an addendum or the email...Thank you sir.
Devajyoti Barman (Expert) 05 May 2013
you can file that but not through you but through your cousin.

It depends on the merit. that is if in the ws ur wife had stated sum thing and that email also confirming the same it is better not to produce the same but if that is a new story then u may produce the same.

Sir,
She is very clever...She has sent this email making allegations against me and ignoring all her wrongs and that she is perfect...So all in all,it`s better not to to show this email I think.

Thank you very much
