Re election on basis of disputed deleted voters

(Querist) 12 March 2017 This query is : Resolved
Dear All,
Thanks for your continuous support. My query is .. is there any provision in law or power to court about re election if a pil is filed representing voters whose name where deleted without information and without proper reason if yes hiw many such voters should be there to do so.
Madhava Rao Gorrepati (Expert) 13 March 2017
once election process commenced the courts do not intervene. before the election process commenced any grievance of non inclusion or deletion of names of the voters would be entertained by the Chief Electoral Officer of the the state concerned. if your grievance is not resolved you can bring this fact to the court by way of writ petition and seek directions. in the meanwhile if the election process commenced court does not intervene. Why PIL? can't those people whose names are deleted approach the CEO of the state concerned? better to encourage them to fight for their rights. Yes. if they are daliths who do not have access to law and who are frightened by local junta then you may consider filing WP after first exhausting your remedy with CEO.
