RE: LOANS/CREDIT CARD

(Querist) 20 January 2011 This query is : Resolved
I would like to know the following :

I am having the loans and credit card dues from different banks in India. The bank has already filed the Civil suit and delivered the notice at my India address against the dishonor of cheque.

ONE OF THE BANK CAME TO KNOW WHERE I AM WORKING PRESENTLY AND HE WAS THREATENING ME THAT “MAKE THE PAYMENT OR ELSE WE WILL TAKE U BACK TO INDIA THROUGH EMBASSY/CONSULATE”.

WILL THE BANK BE ABLE TO DO ANYTHING THROUGH EMBASSY/CONSULATE TO GET ME BACK TO INDIA OR IT IS JUST A PRESSURE TRICKS OF THE BANK? CAN I FILE INSOLVENCY PETITION? WHAT PRECAUTIONARY MEASURES SHOULD I TAKE IN ADVANCE?

Is there any effect to my current job of outside India?

Thks,

Rather then looking for way outs to avoid payment to repay the amount it would be much better to settle the payment in order to maintain credibility.

SIR,

THKS FOR UR REPLY. I WOULD ALSO LIKE TO SETTLE THE MATTER WITH THE BANK ASAP.

BUT IN THE MEAN TIME,I WOULD LIKE THE REPLY ONLY ON THE FOLLOWING POINT :

ONE OF THE BANK CAME TO KNOW WHERE I AM WORKING PRESENTLY AND HE WAS THREATENING ME THAT “MAKE THE PAYMENT OR ELSE WE WILL TAKE U BACK TO INDIA THROUGH EMBASSY/CONSULATE”.

"WILL THE BANK BE ABLE TO DO ANYTHING THROUGH EMBASSY/CONSULATE TO GET ME BACK TO INDIA OR IT IS JUST A PRESSURE TRICKS OF THE BANK? CAN I FILE INSOLVENCY PETITION? WHAT PRECAUTIONARY MEASURES SHOULD I TAKE IN ADVANCE"?

THKS,

AMAN

No unless the aby court in India has passed any order issuing warrant of arrest. The declaraton of you as an Insolvent would definitely help but the case for the same will have to be filed in India.

Dear Mr.Aman,

You have not disclosed as to the country where you are presently working. The Bank in India can certainly create avoidable problems to you even if you are abroad. Therefore, as have been righly advised herein above by different experts, I would also suggest you to settle the matter once for all. Insolvency proceedings are not that easy, that too, for a person working abroad.
