Facts :
My Client respectfully bring to your Notice that, on ______ my client have the purchase order for supplying Bottles & screw caps from you. My client have given the order for purchasing Bottles & screw caps amount of Rs. 17,28,039/- and gave the 50% of advance amount of Rs. 8,64,019/- through online Transfer of funds (RTGS). As per the terms and conditions of the purchase order to the above said company on ______. According to the terms of delivery- Delivery of Goods should be made within the 15 days of from the date of placing of the order and the payment of 50% of advance. Till today you were not able to fulfill the commitment as per the Purchase Order No. ______/2012-13 dt. ___ My client’s advance amount has been enjoyed by you, without supplying materials.
According to the terms and conditions of the purchase order Letter, Balance 50% of amount will be payable only after deliver of the goods. My client have not committed for Letter credit and my client don’t have such kind of facilities with his account.
In case, if you have not satisfied, you should have return the money, but you have not done so, with the intention of the causing losses due to non –supply of materials to my client.
My Client further states that now lapse of more than a year you and your company has failed to perform what we have ordered.
My client instructed me to bring to your notice that pay back the Rs. 8,64,019/- which your company has received from him immediately along with 18% interest. It is hereby informed to you that if nothing is been heard from yours side within 15 days from the date of receipt of this notice my client has instructed to move appropriate forum you for which you will be held responsible for all the costs and consequences, thereon.
