Recovery of money

Querist : Anonymous (Querist) 05 June 2024 This query is : Resolved
I sold goods to another firm three months ago, and they still haven't paid me. I'm looking for remedies to recover the money they owe me. Could you guide me on the steps I can take to ensure they pay what is due? What legal or non-legal actions are available to me in this situation? Any advice on how to handle this would be greatly appreciated.

Is there any evidence that you can file a recovery suit against the firm? Could you consult a local advocate?
T. Kalaiselvan, Advocate (Expert) 05 June 2024
If you have documentary evidence namely invoices and delivery challan, then you can issue a legal notice demanding the payment due to you, stipulating a time limit for repayment/compliance.
Failing to comply with the demands made, you can sue the buyer in the civil court for recovery of your money

Yes, you can file civil suit for recovery of money if you have cogent proofs for sale of goods.

and i have sent a demand notice as well but he has not given any reply and no money, now what shall be the next procedure.

After having served him with the statutory demand notice and found that he has not complied with the demands made within the time stipulated therein, the next step is to file a suit for recovery of money before a civil court within the jurisdiction where the cause of action took place.

Yes, you can file a recovery suit; and it needs to be filed within the period of limitation. Law does not allow any condonation in filing a civil suit.
