Our society is going for redevelopment. Our flat has 2 balconies which we internally converted to room. My question is whether balcony area is considered for redevelopment or not. Eg. If builder decided to give us free10% area whether he will give it based on carpet area mentioned in our property papers ( balcony area is not mentioned as carpet area) or he will not consider balcony area for the same. Our balcony area is 100 sq ft.
The builder will consider the carpet area mentioned in the agreement. If the balcony area is not included in the carpet area (as mentioned by you in the query) then you should get an equal amount of terrace area in the new flat.

Builder is bound to act as per agreement and annexed map. Check Your agreement whether balconies area are covered in that or not.

Yes. the carpet area mentioned In the sale deed/agreement of sale, that carpet area shall be yours and he shall give you.

Redevelopment is based on the terms of the agreement. It is inequitable to bargain too hard on issues deficit in parity.
