Regarding easement

(Querist) 13 March 2014 This query is : Resolved
sir/madam,
last month we open our case (appeal), we did not attend hearing so court gave expartee oder. other party put a case against for asking easement right aginst us for drinking water connection in our land. we having the original doc with us. but they put forgery doc's in court. when they gor expartee order they do some illegal acts like name changing of common drinking water connection in their name and take the connection from our place and put their home.1) is that useful for us in hearing to refuse easement right for them? 2) if we prove that in court what action will be taken by court against them? 3) now shall we made any construction in our place? for that we need court permission what procedure we do?

Your case was exparte so you preferred an appeal?, whether you have filed written statement?, what is your lawyer's opinion?, you need to give more details for a proper opinion/suggestion.

yes sir.. nw we appeal. our lawyer says no prob in that first hearing we put original doc in court. By our grandma's will she told that our property is purchased by my fathers own job money. but defends hide that lines from xerox copy of will and put it in court and says that is an ancestor property we all are joint family. that is the prob here.
