Regarding mutation of land

Hi,
I want to do the mutation of my land in which , we have built our home.
Our home is in private society. Some of our neighbhood already done with the mutation.
Our khasra number is 998 and plot is in lucknow Ismileganj.
For the mutation, I have approached one lawyer. We have given all the required information and he already taken 7000 Rs. from us. Now around 2 years are over, still that lawyer is not able to do mutation and not ready to return the money also.
He is again asking for more money. Everytime he ask for some more money and time.
And after taking the money and time, he is failed to do the mutation without any statisfied reason.
I have three questions:-
-How much time and money is required to do the mutation of the land?
- What is the procedure to do the mutation?
- I am suffered a lot from this laywer, he is making us fool from past 2 years.What action I can take against him?
Please reply to the above three questions.

FOR UNCONTESTED CASES IT SHOULD NOT GO BEYOND THREE MONTHS.MONEY MATTER DIFFERS FROM ADVOCATE TO ADVOCATE,HOWEVER THESE ARE VERY PETTY JOB FOR WHICH ONLY VERY FEW PEOPLE PRACTICE.
- What is the procedure to do the mutation?
AN APPLICATION IS MOVED BEFORE TEHSILDAR ALONG WITH SALE DEED UPON WHICH NOTICE TO VENDOR IS SENT AND WHEN HE IS SERVED AND FILES CONSENT OR DOES NOT FILE OBJECTION,THE MUTATION ORDER IS PASSED.HOWEVER IN THESE OFFICES SOME CORRUPTION AND BUNGLING IS ALSO REPORTEDLY IN PRACTICE .
- I am suffered a lot from this laywer, he is making us fool from past 2 years.What action I can take against him?
IF YOU HAVE PROOF OF HIS ENGAGEMENT AND CASE IS FILED AND YOU KNOW DETAILS AS WELL AS PROOF OF PAYMENT THEN YOU CAN COMPLAIN TO STATE BAR COUNCIL FOR HIS MISCONDUCT.
YOU CAN GO EVEN TO CONSUMER FORUM BUT TWO YEARS PASSED,LIMITATION WOULD BE AN ISSUE ALTHOUGH THAT CAN BE ADDRESSED BY A COMPETENT MIND.

- How I will get know, who is my Tehsildar , whom I have to submit the application?
- What is the prescribed fees/ amount as per the governmant law that Tehsildar will ask for this mutation process?
-Is it necessary, that I will approach any laywer for the mutation ? As I am already suffered from one.

It is necessary, that you engage local Advocate for the mutation , as u do not even know who is Tehsildar. Delegation of job is key to success,

You can get the Talk and Tasildar Address in the Telephone Directory or Government website. The some city corporation revenue department to do the mutation(issues Patta or katha name transfer with sub-divion of survey Number assess the tax).The format applications are available and small private clerk or typist can service you on small charges. If Government Staff approach you money, you may inform by phone to Anti-corruption DSP, they give money and send him to Jail. Any how the Advocate has done offences. He is not above Law, first send complaint to his local Advocat Association if no respons, give the private criminal complaint to same he practise area Magistrate Court because Police is hesitate to take complaint.

Now I will search the Tasildar and do the mutation by myself.
And definetely inform that lawyer about the complaint which I am going to file aginst him.

hi,
My lawyers who has not done the mutation from past 2 years, is now saying that I am not present in hearing so the case is closed.And he has not informed me about any hearing date.
And saying now our file is with court so he is not even able to return the file also.
- please let me know:-
-Is there any hearing in court for the mutation process?
- is lawyer really not able to return the file?

You can approach the office of court directly and there are options to reopen if the case is closed. You can appoint another efficient advocate to handle your case. You can mention to the court that the case has sufferred due to inaction on part of your earlier advocate who never attended the case and not even kept you informed regarding the progress of the case.
