Registered will and encumbrance certificate

Querist : Anonymous (Querist) 12 November 2023 This query is : Resolved
Does encumbrance certificate show details of a registered WILL of that property?

[P. S. The executor of the WILL has not executed the WILL, as the testator is still alive]

No. The Will does not appear in EC whether the testator is alive or not and even registered.

It is a repeated question, however my anser is
The Will shall not reflect in the encumbrance certificate of the property because the Will do not become a title document until and unless it becomes effective or enforceable and after that also the Will will not reflect in the encumbrance. The Will would be registered in the book IV of the registration department hence it will not find a place in the encumbrance certificate

Please donot repeat same story time and again, it is absurd.

While the testator is still alive where is the question of an encumbrance in ther property just because the Will was made by a registered document
