(Querist) 17 April 2013 This query is : Resolved 
An FIR is registered against A,B,C for cognizable offence. During investigation, one witness said that D and E are also involved in the offence apart from A,B,C.
Now the police wants to rely on this statement and wants to register FIR against D and E. Can police register FIR in this case by relying on the above statement of witness keeping in mind the provision of Section 162 CRPC ? What is the proper course of action available against D and E ?
