Registration of land issues

Dear Sir/Madam,
I was on the process of buying a property in Kerala.I signed an agreement with the landlord , which is valued for 3 months and will expire on 26th June 2013.I given 10 lakh rupees as advance.We planned to register the land on 24th May 2013.But couple of days before the registration another party who has case(about another property brought from my landlord) against my landlord attached the purposed land also to the case.
So my landlord informed us the registration is required to postpone for a short time and they will get court order to vacate the attachment. But the 3rd party went to highcourt for further proceedings and there is no hope to get rid of from problem before the agreement expiry date.At this time we informed our landlord that , we lost interest in that purposed land and wants the money back. Then the landlord tell us he is going to pay the money back.But the problem is we can't trust his
words .
Now my question to you is , is it required to sent a legal notice to the landlord claimg our money before the expiry of the agreement?. we contacted one of our lawyer and he said we can trust his words and wait until he pay our money back. If the landlord not pay the money before the expiry date what we have to do.
So I request you to, please advise me with proper instructions

If registration was to be done on 24th may only then, give him a legal notice for refund of money now, otherwise you can wait for performance of contract till 26th june and thereafter give him a legal notice for refund of money bcoz of breach of contract.

Do One thing , take All Powers from Landlord as a Power of Attorney Holder to attend case on behalf of him and take the Legal possession from this power by Mentioning yours investment .

If Any case is pending on any Land then no use of purchasing it but there are ways but we lawyers charge 2% to 10 % for Purchasing Property , and as for traveling and handling 50000 is required to lawyers like me who is handling 50000 acres of lands . Handling lands is not a easy Job .
