What are the fees for registering a ‘special power of attorney’ in Mumbai wherein a husband authorizes his wife (on his behalf and for his benefit) to ‘sell / agree to sell’ his existing residential premises for a valuable consideration and alongside purchase new residential premises from above receipt?
The above ‘special power of attorney’ is given without any consideration.
I understand the registration fees in Mumbai for registering documents relating to property transactions at present is fixed at approximately 1 % of the consideration of the document but subject to a maximum limit of Rs. 30,000.
I also understand that amongst others the registration fee for the following immovable property transactions is leviable on the market value of property:
(a)PoA given for consideration; and (b)Authorising the attorney to sell the property.
Thus would there be any fees for registering a ‘special power of attorney’ given that husband authorizes his wife for sale & purchase of residential premises without any consideration?

The fee for the registration of Special Power of Attorney in Mumbai is just Rs. 1000/- as per information provided by my friend, a lawyer residing and practising there.

For PoA and Special Power of Attorney the registration fees are mostly fixed and does not depend on the sale and/or purchase of anything mentioned in the power. The purpose may be anything but the deed is only a power either General or Special.
