After death of father and as per my father register will of 50-50% equal share we my self & my brother construct a house with collaboration with builder & with mutual understanding & with legal memorandum of understanding in stamp paper. As per this document ground floor & basement in name of my brother, first floor in name of builder & second floor with roof right in my name. Now i wish to register my floor individuality Confirm that I need to sign the paper of registry from my bother also or only with document i.e. register will & memorandum of understanding i register my floor in registrar office.

You need a family settlement and get it registered so that minimum expenses may be got incurred instead of getting registered sale deed.

As you and your brother have jointly made the agreement with the builder,registration of the same would serve the purpose if four months have not elapsed since then.Other wise in my opinion a try party fresh agreement is needed to be registered because of three floors in which middle one has to belong to the builder.

If the Will has been probated, it is the Builder only who needs to get his floor registered at his expense with U as the vendors.

Dear All,
My brother is not interested to sign the paper of registry. It is possible to get my property register with will of my father & memorandum of understanding. Only memorandum is signed by my brother and this paper division of property floor wise is as per will. He is demanding extra money for this.
