Rejection of complaint u/s 156(3) crpc

(Querist) 10 September 2018 This query is : Resolved
First i had complained police for crime u/s 420,468,34 of ipc along with documentary proof but they said that it is civil case then we make complaint to magistrate u/s 156(3) he rejected our plea and just said in order that 'case is not fit for 156(3)'. What is course of action available to me, as i don't want to go u/s 200
Dr J C Vashista (Expert) 11 September 2018
Move an appeal before Sessions Court against the impugned order passed by MM/JMIC dismissing your application u/s 156(3) Cr PC, if you feel aggrieved.
What is your locus standie to the complaint?
Why are you reluctant to proceed the case u/s 200 Cr PC?

Thank you, dr JC Vashista for your reply. In our case there is 7 co-owner . I also one of them . 2 of them sell their whole share in property their name got brackets in property card at city servey office later on they removed my and my brother in law name and removed brackets on their name and again sell the proprty by increasing their share in property. There are no mutation entries on such property card about how their name's brackets are removed . For this we have filed police complaint but the other party managed police so police said us that it is a civil case. Then we have filed complaint u/s 156(3) but the magistrate does not order 156(3) investment and just write in his order that this case is not fit for 156(3). We does not want to continue with section 200 because in that private case criminal will get bail easily and we have to appear on every court hearing date
