(Querist) 09 August 2011 This query is : Resolved
Hi,
I am working in Pvt. ltd company. On 1Aug 2011, I have resigned my job with 30n days notice period as per company rule mentioned in appoint letter. But one of the senior person with relieving authority told me that I can not accept your resignation, hence you will not be relieved or you will not get the relieve letter. I have joined before 2 & half months before. Now I am on probation period for six months. Pls. suggest me what to do as early as possible.
Thank you all.

File a civil suit for mandatory injunction against company with an application for ad-interim-injunction u/o 39 r 1 & 2 for getting your resignation accepted with all consiquential effects.

Sir,

Then you may discuss with the officers of your company and take the assistance of your senior colleagues (your welwishers). Good luck.

Place the circumstances which led you to resign your job and try to convince the authorities, so as to get relieving letter.

Already replied against your similar question elsewhere. However, the reply is repeated here also, as follows:

If you don't have any proof of submission of your resignation letter, you need to take proper caution not to get yourself treated as absent without permission on leaving your job. In that case, you may better submit your reminder notice by Registered Post Acknowledgment Due, in addition to sending an email reminder, making a clear mention that the resignation may be deemed to have been effective with effect from ......... (mention date) if no response is received from the management. Also refer the original notice and attach a copy of the original notice with the reminder notice.

It will be better to go to the HR and ask for your reliving date.
Just sent a written mail to HR by mentioning the facts. do complete all formalities & document complete from your end.
