You may terminate the tenancy and file suit for eviction and also for recovery of rent. The suit can be filed on the ground of default in payment of rent and also for bonafide requirement for personal use which includes use by any family member, if the family is joint. Of Course it will take time for the decision of the suit. But if you request the court to expedite the hearing, you may get the decision bit early. There are no special provisions for NRI in the matter of eviction.
