Rental agreement - partnership firm -

(Querist) 11 March 2021 This query is : Resolved
Dear Sir,

Me and my mother going to start partnership business. We are going to use part of our house as office. The house is in my mother's name. Whether I have to create a rental agreement between my mother and company. Or else tax reciept or eb reciept is enough for address proof to gst, deed and pan. thanks

Yes, Execution of rent agreement between tenant ( company ) and landlord ( your mother ) is not only essential for getting GST & PAN but also required for registration of partnership firm with Registrar of Firms as address proof.

In the Partnership deed, you and your mother are partners. hence one of the Partners having a house and gives a room for office purposes, a Notarised Affidavit is sufficient.

Any suggestion depends upon the terms of the proposed use.

The house is a residential in a colony, society or anywhere else ?
Is it permissible (as per municipal laws) to start commercial activities from the house owned by one of the partener ?
