In one of my client's complaint,Court had sent the matter u/s 202 Cr.P.C. for investigation.However the I.O. had been won over by accused and so I.O. submitted a wrong report in court.Now whether Court can resend the matter to some higher official of police u/s 202 Cr.P.C.

at the filing of IO report , the magistrate is under mandatory obligation to supply the copy to you and discuss the report and you have to file or orally tell what is the wrong facts that are stated in the report and how the report is wrong and does not disclose the actual facts/incident. on your submission Magistrate can order for further investigation if in the discretion of Magistrate it is wrong.
