I am working in a Public Sector Bank and I served resignation letter giving notice of 3 months. The reason for resignation is the work culture of the bank which includes harrasment of staff for business targets. I already have a staff accountability pending which is based on compliance level issues. The reply to the same has been furnished before 10 months but no further communication received on the matter afterwards. So there are chances that my resignation won't be accepted. In that case how I can relieve from the organisation. I want to get my full terminal benefits also as I have availed loans which can be closed with the help of those terminal benefits only. If my resignation is not accepted I want to exhaust the entire leaves to my credit so I can get full salary for that period. Kindly advise what legal help I can take in case my resignation is not accepted, my leave request is rejected or my terminal benefits not paid?

You can make a representation in writing to the competent authority through proper channel expressing your grievances and request for direction to the concerned department to relieve you from the job expeditiously and also to settle the full and final settlement at the earliest. Failing to receive an favorable reply or response you may approach high court with a writ petition against the bank management for relief and remedy provided you are are working in the officer cadre

I am in officer cadre only and has almost completed 9 years of service in the bank. Even NOC for my passport renewal not granted quoting the reason as vigilance clearance not received.

In the given situation, after exhausting the remedies before the top management of the organisation you may approach high court with a writ petition seeking to get your grievances redressed

You must be a member of Officers' Association. Please approach them for their assistance in the matter. Banks are run on robust HR policies guarded by very strong Unions and Associations. No management can take any unjustified action against any employee or Officer. Please approach your HR concerned through your Association/Union representative for amicable resolution of the issue. Resorting to legal action should be the last only as a desperate measure. If court case is filed prematurely, all other doors get closed, management becomes quite hostile and Bank fights the case tooth and nail with all its might at its disposal.
Therefore, resolution of issues with consultation through Union/Association is best.
