Sir,I,clerical staff of state bank of patiala,was appeared for the promotion test to officer (jmgs-1),whose result was declared on 11th April,2015 but promotion would be effected from 1st june 2015. As disciplinary proceeding was pending on 11th april, later a letter I got from hrd regarding my result in sealed cover.On 21st may penalty of CENSURE was imposed on me but promotion was effected from 1st june .So please guide me accordingly,whether I am eligible for promotion or not.

If there is any disciplinary proceeding is pending, then the result of the promotion committee will be kept in a sealed cover.
The sealed cover will be opened only if the disciplinary proceedings concludes in favour of the employee.
In your case you have been Censured. Censure is also one of the punishments.
Therefore, in my view, the sealed cover will not be opened, and you will not be given promotion now.
However, you will be considered for promotion in future as 'censure'is not a bar for future promotion.

In some Banks Censure has effect for one year and promotion is not considered during this period. Confirm the position in your Bank.
However, you have been punished in the disciplinary proceeding, you may not be promoted for in this attempt.

No doubt "Censure" is one of the punishments. Please go through the State Bank of Patiala rules and find out the effect of "Censure" on the promotion.
The effect of "Censure" on the promotion varies from department to department under the rules.

Generally, 'censure' results in the sealed cover not being opened. You have the option of appeal against the penalty and if not successful, availing of the judicial remedy.
