Hello sir my ques.is
What are the rights of a muslim woman in his father property after his death .
My mother age is 55 and my grandfather has died.
She has two brothers and one sister.
Can my mother claim for her right in his father property ?
If yes then how?
And my grandmother had not any will.

Your mother is a legal heir to the property of her late father. The extent vesting depends upon the school you belong to.

As per to Sunni Sect the son always gets twice that of the daughter thus the ratio is 2:1. An Indian Muslim inheritance is considered as an integral part of Shariah Law Act 1937.

Dear Alam Ji, The share of inheritance depends on the School of Muslim Law to which you belong. There is a considerable difference from school to school.

In all possibility, your mother would inherit the property of her deceased father. The procedure for claiming the share is of course by way of the procedure prescribed in the Indian Succession Act, 1925 (procedure of Letter of Administration).

Consult a local lawyer to take care of all the procedural matters as the case requires a very extensive documentation and court attendance.
