rights against the developer in pagdi system chawl

respected sir,
I reside in a pagdi system chawl since my birth, the property was owned by my dad he passed away last year. so how can we transfer the property in my mothers name & the builder has taken the ownership rights to develop a building from past 9yrs. however no construction started yet neither the agreement is made and he is also not allowing to increase the height of our house, the height of our home is 6feet at the entrance because of that people passing by the house does get hurt because of this.the builder is not allowing to increase the height of the property neither make any changes in home. please recommend what can be done and what are our rights against the builder in regards to this property.

Sir,
In a pagdi system property you do not own the premises where you stay, you are only a tenant.
As per the Maharashtra Rent Control Act 1999, you have only statutory rights of residence, you can not make any structural alterations without the permission IN WRITING of the Landlord.
You can make a written complaint to your municipal ward officer about the deteriorating conditions of your room, and any difficulties that you may be facing there.
