Rti reply on police complaint

Sir - I had filed a police complaint against a person who cheated me for a good amount of money. Though I did not have any documentary evidence but gave police the video recording, voice recording and text of sms and transcript of voice conversation clearly establishing his cheating act. Incidentaly there was another complaint of cheating filed by some other person in same police station against the same accused for which there was documentary evidence.
After waiting for 8 months , I filed RTI to know the status of my complaint.
Now my RTI has been replied saying that since there is no documentary evidence hence they cannot take action basis allegations.
Is reply of police justified. Can I appeal to the reply since I am not satisfied. what are other remedies available for me. Is police not bound to investigate my case basis another complaint of fraud against same cheater.
