Running private coaching classes in registered co op hsg soc

Sir
one member Mr & Mrs Bhattacharya are running classes in our complex which is registered co op hsg soc .Members have objected & society has also written him letter to stop but they are not stopping by saying tuttion classes are not commercial it is professional 7 i will complaint in womens right,child abuse, 7 criminal offense of harrasment

Running private tuition is not an offence. It is not professional, now it is commercial. If it is causing any obstruction to the society members then you can file a suit for injunction against the persons who are running the tuition classes

Society has no power to permit for activities other than residential purpose . No commercial activity can be initiated therein without written permission of society.You may file a case against the said Coaching Classes for this nuisance.First give him notice through lawyer and thereafter file a case for nuisance

Private coaching is not offense. You will have more trouble making complaint paying legal fees.

You may also invite cross complaint since some of your activities may also be disturbance to others.

Please check from the municipality of the city you are residing. Some activities are permitted from residence. You may check if in your town coahcing classes is permitted activity.

Municipality has nothing to do with the administration of the society. If soceity deemed such activity as commercial then it should not be permitted. No case can be filed by such couple.

Such type of problems are decided as per the by laws of the Society. No other authority/institution can interfere with it.

If the Society by laws permits for a commercial activity then running a coaching class is nothing wrong.
