Sale deed after the death of property owner

(Querist) 27 October 2015 This query is : Resolved 
Resp. sir, I want to know about the validation of the agreement to sale which has been done by the power of attorney holder after the death of property owner. The Power of attorney was registered and also witnessed signed by the owner's son and son is still alive. Will this registry valid in the court or not ?

On the demise of the Party giving power of attorney, registered or otherwise , the Power of Attorney becomes defunct ,uno flattu, with the demise of the person making the PoA.

The POA deed will be defunct and invalid in the eyes of law after the death of the principal. It cannot be held as a valid evidence in the court though it was registered and has been witnessed by the son of the principal.
