Sale of flat - society administration with registrar of co-op society.

Respected Experts,

Whats is the procedure for transfer of flat and Share certificate, in the name of the buyer when the society is currently administered by the Registrar of Co-operative housing society as per Maharashtra Co-operative Societies Act ?

Please guide.

The seller must have obtained NOC prior to making sale as it is mandatory to do. Now you shall have to enclose the copy and NOC with your application to the registrar and shall have to deposit the desired fee. After due verification of the documents, the registrar shall do the needful.

i dont know about Maharashtra Co-operative Societies Act., even am completly agree with makkad sir..

Same procedure, instead of submit to Mag Com, co-op soc, submit to Adm, Registrar co-op soc as per Mah co-op soc act.

mr makkad . please note that under model bye laws NOC of society is not mandatory requirement for transfer of flats in maharashtra . you need permission of the adminsitrator appointed by Registrar
