Hi, This is with reference to the credit card payment issue. I am having SBI credit card. But as i lost my job few months back and still struggling to get a job, I was not able pay the bills incurred on SBI credit card. At the time of issue of credit card balance in 127000 and now the outstanding is 155000. i have paid the minimum balance more than the outstanding. But from past 6 months am not able to pay even minimum amount. i have maid a settlement with sbi to make payment of 92k at one shoot but unfortunately i couldn't make that also now there is any possibility to issue a non-bailable arrest warrant on me. i have got a message like"Non Bailable Warrant for xxx (on my name) by our client U/S IPC 420,403,58,138. Can you please suggest me how to over come this.

Once you issue an Cheque no doubt you would be in Soup.if it is dishonored.. Better make all the efforts immediately to settle it.Or else seek the protection and defence thro an Criminal side lawyer.

Unbelievable story! When you have not discussed about any court case against you by the SBI, how the question of issue of NBW has arisen?

If you issued duly signed bank cheque for payment of due amount and that get bounced, the chances of getting involved in criminal proceedings under NI Act possible along with provisions of Penal Code.

Apparently the one liner SMS posted by you is sent by legal cell/lawyer of M/s SBI Cards and Payment Services Private Limited that also uses style of SBI Cards…… and because you have entered into settlement by your free will and instrument of payment has returned unpaid….
or some ARC/recovery agency contracted by M/s SBI Cards and Payment Services Private Limited….

Do you mean that you have paid more than Rs.155000/- or say Rs.144000/ or Rs.92000/?
Take help of your own very able senior LOCAL counsel(s) of unshakable repute and integrity specializing in consumer matters and having successful track record …and worth his/her salt…
Visit Local Consumer Forum and inquire…
CC is for those who find IT difficult to carry cash and have to spend frequently and can pay back…
Otherwise Debit card may be used…
In future don’t use CC if you cannot pay.
Lean on your LOCAL counsels to come out of the mess..

You hve credit card dues.
the recovery agents at times threaten of criminal action.
Presently it is civil suit only which bank can file.
for landing in criminal case you have to sign a cheque which bounces.
But make some settlement. otherwise interest keep swelling every day with each sunrise.

Settle the issue amicably if the bank agrees refer the matter to Lok Adalat which settles your issue to both of your satisfaction in a jiffy. Many such cases Lok adalats are settling and it's binding on both of you and its decree is equal to civil court decree under Legal Authorities Act.Lokadalats are attached to each District Court.

Don’t issue cheque if you don’t have money..
RBI had advised to settle matters in Lok Adalat..
CC companies conduct camps and attempt to collect usurious charges…IT is fat earning.
Settlement is adverse entry…in credit history until or unless proper written and irrefutable T&C are negotiated and settled to call back name from list of defaulters…..
If you can settle in permanent Lok Adalat…
Cheque bounce is opportunity that CC member shall provide to CC Company to get full payment plus legal expense etc ….

As already suggested take help of a very able LOCAL counsel…
Such counsel may help you without FEE or for FEE that you may feel is negligible..
Try for IT.
Preferably consult and come out of the mess..

Prima facie it is a fabricated story for academic debate, however, if there is some truth consult a local lawyer to take appropriate action against the recovery agents/gHoons of SBI.
