School authority neglect their own student

School Admission
Dear Sir,
My nephew is a student of class 4 and promoted to class 5 in a well known private school.
But school authority has published a list of 28 candidate only who will be taken to class 5 to their school only.
My nephew got 75% marks and list end till 76% mark only.
Authority now taking admission student from others school and they are not taking rest of the student from their own school.
My question is
1)Can any private school can do such to their own student ?
2)Will Right to education act help to protect such conduct ?
3)Can i take legal help against school ? please guide

complain to state education department against said school . school cannot arbitrarily deny promotion to student if he has passed the exams of 4th standard .

For any complaint against the Private independent schools affiliated with the Board complaint should be sent to Joint Secretary (Affiliation), CBSE, 2, Community Centre, Preet Vihar, Delhi-110092.
